# EU Cookie Policy

This Cookie Policy explains how SIA Triumph Arcade Europe (“Triumph”, “We”, “Our” or “Us”), with registered office at Laipu iela 6, Rīga, LV-1050, Latvija, uses cookies, SDKs, mobile identifiers and similar technologies on our websites, applications and digital services (collectively, the “Platform”).&#x20;

This Cookie Policy has been prepared having regard to Regulation (EU) 2016/679 (the “GDPR”), Directive 2002/58/EC (the “ePrivacy Directive”) and applicable national laws implementing the ePrivacy rules in the jurisdictions where the Platform is made available.&#x20;

This Cookie Policy forms part of and should be read together with Our [Privacy Policy](https://docs.triumpharcade.com/).

This Cookie Policy should also be read together with the Cookie Settings Panel (the “Cookie Settings Panel” being the preference management interface accessible on the Platform that allows you to view and configure your cookie preferences). The Cookie Settings Panel contains the operative and most up-to-date information about the cookies and similar technologies used on the Platform, including their providers, purposes, retention periods and, where applicable, international data transfers. In the event of any discrepancy, the information displayed in the Cookie Settings Panel shall prevail, as it reflects the cookies actually deployed at the time of your visit.

#### 1. What are cookies and similar technologies?

Cookies are small text files that are stored on your device (computer, tablet or mobile phone) when you visit a website. They allow the website to recognize your device and remember information about your visit, such as your preferences, settings or login status. Similar technologies include SDKs (software development kits), mobile advertising identifiers, device permissions, pixel tags, web beacons, local storage and other tracking mechanisms that perform comparable functions within websites and mobile applications.

#### 2. Legal basis and consent requirements

Under the ePrivacy rules, We may store or access information on your device without consent only where this is strictly necessary to provide a service expressly requested by you or for the transmission of a communication over an electronic communications network. Where the use of cookies or similar technologies involves the processing of personal data, Triumph will also rely on the applicable legal basis under the GDPR, as further described in this Cookie Policy and Our [Privacy Policy](https://docs.triumpharcade.com/).

For all cookies and similar technologies that are not strictly necessary, including analytics, personalization, advertising, attribution, measurement and non-essential SDKs, We will obtain your prior consent before placing them on, or accessing information from, your device. Consent is requested through Our cookie banner or preference centre and must be freely given, specific, informed and unambiguous. Continued browsing, inactivity, scrolling or closing the banner does not constitute consent, and We do not use pre-ticked boxes or similar mechanisms.

Where We present an “Accept all” option, We also provide an equally accessible “Reject all” option in the same layer and a way to manage choices by category. You may withdraw or modify your consent at any time through the Cookie Settings Panel without affecting the lawfulness of processing carried out before its withdrawal.

#### 3. Types of cookies We use

We may use the following categories of cookies and similar technologies on the Platform:

* Strictly necessary cookies. These cookies and similar technologies are essential for the Platform to function and to provide services expressly requested by you. They enable core functionalities such as user authentication, session management, security, fraud prevention measures necessary to protect the integrity of the service, jurisdictional eligibility checks required to make the service available to you, payment flows requested by you, cookie preference storage and load balancing. These technologies are used without consent only to the extent that storing or accessing information on your device is strictly necessary for those purposes.

Certain features of the Platform, including fraud prevention, anti-cheating measures, geolocation verification and jurisdictional eligibility checks, may be required to provide the gaming service requested by you securely and to make the Platform available only where you are eligible to use it. Where these technologies are technically indispensable to provide the service requested by you, they may be treated as strictly necessary. Where the same or related technologies are used for analytics, product improvement, model training, advertising, profiling, personalization or any other purpose that is not strictly necessary to provide the requested service, We will request your consent where required.

* Analytics and performance cookies. These cookies collect information about how users interact with the Platform, such as pages visited, time spent, error reports and usage patterns. This information is used to understand and improve the performance, functionality and quality of the Platform. Analytics and performance cookies are not deployed before you have given your consent. Where these cookies involve third-party providers, those providers, their purposes, retention periods and any applicable international data transfers are identified in the Cookie Settings Panel. * Personalization and preference cookies. These cookies allow the Platform to remember choices you make, such as language, region or display preferences, and to provide enhanced or customized features. Preference cookies that merely remember choices expressly made by you may be treated as strictly necessary where they are required to provide the feature requested by you. Personalization based on your behaviour, inferred interests, use across sessions or interaction with content will require your consent where required by law. Legal basis under the GDPR, where personal data is processed and the cookie is not strictly necessary: your consent.
* Advertising and measurement cookies. These cookies may be used to deliver relevant advertising, limit the number of times you see an advertisement, measure the effectiveness of advertising campaigns, perform attribution, and build or infer a profile of your interests in order to show you relevant content or advertising. Where We use advertising or measurement cookies, We may share data with advertising partners, ad networks, attribution providers or measurement providers. These cookies are deployed only with your consent. Legal basis under the GDPR, where personal data is processed: your consent.

Depending on the relevant service and processing activity, advertising and measurement partners may act as processors, independent controllers or joint controllers. Where Triumph and a partner act as joint controllers for specific processing activities, the essential terms of the relevant arrangement are made available through Our [Privacy Policy](https://docs.triumpharcade.com/), the Cookie Settings Panel or another notice linked from the Platform. Further information about each provider is available in the Cookie Settings Panel and in the provider’s own privacy notice.

#### 4. Third-party cookies

Some cookies and similar technologies used on the Platform may be provided by third parties, such as analytics providers, advertising networks, attribution providers, payment processors, fraud prevention providers or other service providers. Triumph determines which third-party technologies are integrated into the Platform and seeks consent for their use where required. Certain third parties may also process the data collected through their technologies for their own purposes, as described in their privacy notices and in the Cookie Settings Panel.

The third-party providers whose cookies or similar technologies may be used on the Platform, together with their purposes, roles, retention periods, privacy notices and, where applicable, international data transfer information, are identified in the Cookie Settings Panel. Triumph requires its service providers to process personal data in accordance with applicable data protection legislation and the contractual arrangements entered into with Triumph.

#### 5. International Data Transfers

Some third-party providers whose cookies or similar technologies are used on the Platform may process personal data outside the European Economic Area. Where such transfers occur, Triumph ensures that appropriate safeguards are implemented in accordance with Chapter V of the GDPR.

The Cookie Settings Panel identifies, where applicable, whether a provider may process personal data outside the European Economic Area and the transfer mechanism relied upon by Triumph. Depending on the provider and the relevant transfer, these mechanisms may include an adequacy decision adopted by the European Commission, certification under the EU-U.S. Data Privacy Framework where the provider is certified and the relevant processing is covered by that certification, or the European Commission’s Standard Contractual Clauses together with supplementary measures where required.

#### 6. SDKs and similar technologies in mobile applications

In addition to browser cookies, the Platform's mobile applications may use software development kits (SDKs), mobile advertising identifiers (such as Apple's IDFA or Google's Android Advertising ID), local storage, device permissions and similar technologies. These technologies perform functions comparable to cookies and may be used for technical operation, security, fraud prevention, analytics, payment processing and, where applicable, advertising measurement, attribution or personalization. Device permissions themselves are not cookies but may enable access to information stored on your device where permitted by applicable law.&#x20;

Operating system permissions, including Apple’s App Tracking Transparency prompt, do not replace any consent required under applicable data protection or ePrivacy laws. Where consent is required, non-essential SDKs and similar technologies will not be activated for the relevant purposes before consent is obtained.

On iOS devices, access to the IDFA for tracking purposes is subject to Apple’s App Tracking Transparency framework, and Triumph will display the required prompt before accessing this identifier for advertising or cross-app tracking purposes. On Android devices, you may manage advertising identifiers and ads personalization through your device settings. These device-level controls apply in addition to, and do not replace, any choices you make through the Platform’s Cookie Settings Panel or in-app preference centre.

#### 7. Cookie duration

Cookies may be either session cookies or persistent cookies. Session cookies are temporary and are deleted when you close your browser or application. Persistent cookies remain on your device for a defined period or until you delete them. The retention period for each cookie or similar technology is identified in the Cookie Settings Panel. Cookies and similar technologies will not be retained for longer than is necessary to fulfil the purposes for which they were collected.

Where We materially change the duration or purpose of a non-essential cookie or similar technology, We will request your consent again where required by applicable law.

#### 8. How to manage or withdraw your consent

You can manage, configure or withdraw your cookie consent at any time through the Cookie Settings Panel available on Our website or application. Withdrawal of consent is as easy as giving consent. Where you withdraw consent, We will stop using the relevant non-essential cookies and similar technologies for the purposes for which consent was withdrawn, subject to any technical limitations and to any processing that remains lawful under applicable law.

You may also manage cookies through your browser or device settings by adjusting your preferences to block or delete cookies. Please note that disabling certain cookies may affect the functionality of the Platform. Rejecting or withdrawing consent will not affect the use of strictly necessary cookies required for the operation of the Platform or for services expressly requested by you.

For mobile applications, you may also manage advertising identifiers, tracking permissions and similar privacy settings through your device settings, in addition to the choices available through the Platform’s Cookie Settings Panel or in-app preference centre.

The Cookie Settings Panel allows you to accept or reject cookies by category and to change your preferences at any time. Your previous consent and refusal choices will be stored and can be updated without affecting the lawfulness of processing carried out before withdrawal.

We keep records of consent and refusal choices for accountability purposes, including the date and time of the choice, the version of the information presented to you, and the categories or providers accepted or rejected. Consent preferences used to remember your choices are retained for a maximum period of twelve (12) months, after which We may request your consent again, unless an earlier request is required because of a material change in the cookies or similar technologies used on the Platform. Records kept for accountability purposes may be retained for as long as necessary to demonstrate compliance with applicable law.

#### 9. Transparency regarding cookies

The list of cookies and similar technologies used on the Platform may change over time as services evolve. The Cookie Settings Panel is updated regularly and reflects the cookies and similar technologies deployed at the time of your visit, including their providers, purposes, retention periods and, where applicable, international data transfer information. Where We introduce new non-essential cookies or similar technologies, or materially change the purposes for which existing technologies are used, We will request your consent where required by applicable law.

#### 10. Updates to this Cookie Policy

We may update this Cookie Policy from time to time to reflect changes in the cookies We use, applicable legislation, regulatory guidance or the features of the Platform. The current version will always be available through the Platform, indicating the date of the last update. Where material changes significantly affect your rights or involve new non-essential cookies or similar technologies requiring consent, We will inform you and, where required by applicable law, request your consent again.
